01 Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Thunderbolt Sales Systems LLC ("Company," "we," "us," or "our"), a Georgia limited liability company located at 8735 Dunwoody Place Ste N, Atlanta, GA 30350.
By engaging our services, submitting payment, signing an order form or service agreement, or accessing any deliverable we provide, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you may not use our services.
02 Services
What We Provide
Thunderbolt Sales Systems provides AI-powered sales automation services for home service contractors, including but not limited to:
- Custom website design and development on the GoHighLevel (GHL) platform
- Missed-call text-back automation setup and configuration
- Multi-touch lead follow-up sequence (SMS and email) design and deployment
- Self-booking calendar integration and configuration
- Google review request automation setup
- CRM pipeline setup and contact management configuration
- Monthly performance reporting and ongoing system optimization
Service Delivery
We target a 7-day delivery timeline from completion of your onboarding call, subject to timely receipt of required information and assets from you. Delivery timelines are estimates, not guaranteed completion dates.
Third-Party Platforms
Our services are built on and depend on third-party platforms. We are not responsible for outages, changes, or discontinuation of these third-party services, but will make reasonable efforts to maintain continuity.
03 Payment & Billing
Fees
Our standard pricing is a one-time setup fee plus a recurring monthly subscription fee, as detailed on our pricing page and in your service agreement. Fees are subject to change with 30 days written notice.
Billing
Setup fees are due prior to commencement of work. Monthly subscription fees are billed in advance on a recurring basis beginning the date your system goes live. Payments are processed via Stripe or another approved processor.
Refunds
Setup fees are non-refundable once work has commenced. Monthly subscription fees are non-refundable for the current billing period. Refunds may be issued at our sole discretion in cases of non-delivery or material breach by the Company.
Late Payments
If payment fails, we will make reasonable attempts to notify you. Services may be suspended after 7 days of non-payment and terminated after 30 days. Reactivation may require payment of outstanding balances plus a reactivation fee.
04 Booked-or-Free Guarantee
Our Guarantee: If your Thunderbolt system does not generate at least 3 additional booked jobs within your first 30 days after system launch, your second month of service is provided at no charge.
Conditions
- Your system must be fully deployed and live for the complete 30-day period
- You must have an active phone number with sufficient call volume (minimum 5 inbound calls during the period)
- You must use the GHL CRM to track leads and mark jobs as booked — results cannot be verified without proper pipeline usage
- A "booked job" is a new customer appointment confirmed via the system (not existing clients)
- You must notify us in writing within 5 business days of the 30-day period ending to claim the guarantee
- The guarantee applies to one 30-day period only and is not renewable or stackable
The guarantee covers one free month of the recurring subscription fee only. It does not cover the setup fee or any third-party costs.
05 Client Obligations
To receive the full benefit of our services, you agree to:
- Complete the onboarding questionnaire accurately and promptly
- Provide requested business information, login credentials (as needed), and brand assets in a timely manner
- Maintain an active GoHighLevel subscription and phone number for the duration of the engagement
- Respond to our communications within 3 business days
- Use the CRM pipeline to track leads and mark job outcomes so we can measure performance
- Comply with all applicable laws, including A2P 10DLC registration requirements for SMS
- Notify us promptly of significant business changes (phone number, trade/service area, etc.)
Delays or failures in your obligations may affect delivery timelines and performance, and do not entitle you to refunds or guarantee claims.
06 Intellectual Property
Our Materials
All templates, workflows, automation sequences, system architectures, and proprietary processes created or provided by Thunderbolt remain our intellectual property. You receive a limited, non-exclusive license to use these materials for your own business purposes during an active subscription.
Your Materials
You retain ownership of all content, data, brand assets, and customer information you provide or that is generated through your use of the system.
Upon Termination
Your license to use our templates and workflows ends. You retain access to your data and any custom content created specifically for your brand. We provide reasonable data-export assistance within 30 days of termination.
07 Data & Privacy
Our collection and use of personal data is governed by our Privacy Policy, incorporated into these Terms by reference.
Your Customer Data
You are the data controller for your customers' personal information and are responsible for ensuring you have appropriate legal basis to collect and process it and to send automated messages through our system.
Data Security & Retention
We implement reasonable technical and organizational measures to protect data, but no system is completely secure. We retain your data for the duration of the engagement plus 90 days, with 30 days notice before deletion following termination.
08 SMS & Communications Compliance
Our services include automated SMS messaging on your behalf. You acknowledge and agree:
- You are responsible for ensuring all SMS recipients have provided appropriate consent
- You are responsible for completing A2P 10DLC registration for your business phone number — we assist and guide, but the legal obligation rests with you
- You will not use our system to send spam or communications that violate the TCPA, CAN-SPAM Act, or other applicable law
- You will maintain opt-out mechanisms and honor STOP requests promptly
- We are not liable for fines or legal actions arising from your failure to comply with SMS regulations
SMS and email sending costs may incur additional carrier or platform fees based on volume; these are your responsibility and separate from our service fee.
09 Disclaimers & No Guarantees of Results
Our services are provided "as is." While we are committed to delivering high-quality automation systems, we do not guarantee specific business outcomes, revenue increases, lead volumes, or booking rates beyond what is stated in our explicit guarantee terms above.
Results depend heavily on factors outside our control, including your market, call volume, pricing, quality of service, and how you manage leads. We disclaim all warranties, express or implied, to the fullest extent permitted by law.
10 Limitation of Liability
To the fullest extent permitted by law, Thunderbolt Sales Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunity, even if advised of the possibility of such damages.
Our total cumulative liability for any claims arising from these Terms or our services shall not exceed the total fees paid by you to us in the three (3) months immediately preceding the claim.
11 Termination
By You
You may cancel your subscription at any time by providing written notice to sales@thunderboltsalessystems.com at least 7 days before your next billing date. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
By Us
We may terminate or suspend your access immediately if you breach these Terms and fail to cure within 7 days of notice, fail to make payment after reasonable notice, use our services unlawfully, or engage in abusive conduct.
Sections relating to payment, intellectual property, disclaimers, limitation of liability, and governing law survive termination.
12 Governing Law & Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law provisions.
Any dispute shall first be submitted to good-faith negotiation. If not resolved within 30 days, disputes shall be resolved by binding arbitration in Fulton County, Georgia, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court. You waive any right to participate in a class action or class-wide arbitration against the Company.
13 Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify active clients of material changes by email at least 14 days before they take effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
